Welcome to PaisaTrips. By using our website, booking services, and participating in our experiences and tours, you agree to comply with and be bound by the following Terms of Service. Please read them carefully.

1. Definitions and Scope of Application

  • PaisaTrips: Platform and agency managing and coordinating tourist experiences in Colombia.
  • User/Client: Person accessing the platform or booking a tour.
  • Primary Traveler: Person making the booking and payment, responsible for companions.
  • Companions: Additional people registered under the Primary Traveler's booking.

2. Account Registration and Personal Data

All information provided during the checkout process (full names, ID number for insurance, phone, and email) must be true, accurate, and updated. Minor registration must be carried out exclusively by their legal representative. The processing of collected personal data is governed by our Privacy Policy, aligned with GDPR (EU) and CCPA/CPRA (USA).

3. Pricing, Currency, and Payment Gateways

Prices can be displayed in USD or COP. Payments are processed securely via Wompi (domestic in COP) and Stripe (international in USD). PaisaTrips does not store card data, complying with international PCI-DSS standards.

4. Cancellation and Refund Policy

A strict cancellation policy applies, calculated from the local tour start time (Colombia time):

  • More than 48 hours in advance: Reembolso del 100% of the amount paid.
  • Between 24 and 48 hours in advance: Reembolso del 50% of the amount paid.
  • Less than 24 hours in advance or No-Show (Inasistencia): No refund applies.

For EU consumers, under Article 16(l) of the EU Consumer Rights Directive (2011/83/EU), the 14-day right of withdrawal does not apply to accommodation, transport, car rental, catering, or leisure services with specific execution dates.

5. Itinerary Modifications and Force Majeure

PaisaTrips reserves the right to modify itineraries due to force majeure (extreme weather, strikes, natural disasters, road closures) to ensure safety. In case of complete cancellation due to force majeure, rescheduling or a full refund will be offered.

6. Mandatory Travel Insurance and Medical Assistance

Our experiences and tours do not include any type of international travel insurance or medical assistance. It is the mandatory and exclusive responsibility of each traveler to hold active international health insurance covering outdoor adventure activities in Colombia. By booking, you release PaisaTrips from any medical, rescue, or emergency costs.

7. Assumption of Risks and Limitation of Liability

The client understands that outdoor and adventure tourism carries inherent risks. To the maximum extent permitted by law, PaisaTrips is not liable for personal injury, death, luggage loss, or indirect damages during the experience, except in cases of proven gross negligence. Our total liability is limited to the amount paid for the tour.

8. Traveler Obligations and Conduct

Travelers must report health restrictions before booking. Drug consumption or alcohol abuse during the tour is strictly prohibited. PaisaTrips operates under a zero-tolerance policy against illegal activities, including child sexual exploitation (Law 679 of 2001 in Colombia). The guide can terminate service immediately without refund for non-compliant clients.

9. Applicable Law, Jurisdiction, and Dispute Resolution

These Terms of Service are governed by the laws of the Republic of Colombia. Any dispute will first be resolved via friendly conciliation. If no agreement is reached, exclusive jurisdiction lies with the courts of Medellín (Colombia).
